TERMS AND CONDITIONS

Effective as of July 2025

This terms and conditions (“Terms and Conditions”) is an agreement that governs the relationship between the User (“You”, “Yours”, “Yourself”, or “Users”) and PT Pura Barutama (“We”, “Us”, or “Our”), a limited liability company duly established and legally operating under the laws of the Republic of Indonesia. This Terms and Conditions governs Your use of Our website and its contents provided by Us (“Platform”) as well as use of Our features available on Our Platform ("Feature” or “Features”).

We may update the Terms and Conditions from time to time for legal reasons, regulatory reasons or should We see that such Terms and Conditions needs to be updated. In such case, We will reasonably inform You of such changes, including through the use of notifications in the Platform prior to the changes becoming effective. If You continue to use Our Platform and/or Features after the changes has come into effect, You hereby agree to be bound with the new Terms and Conditions.

1. Definition

You, Yours, Yourself, or Users means You, an individual using Our Platform;

Applicable Laws refers to all applicable laws, regulations, decisions, or provisions established by the authorities in the territory of the Republic of Indonesia;

We, Us, or Our means Us, PT Pura Barutama, who organizes and operates the Platform and/or Features;

Third Party Content are contents created or developed by a third party, such as the contents or features provided on Our Platform;

Feature or Features means any features that are available on Our Platform, including but not limited to the Inquiry Form and the Job Opportunities Form;

Privacy Notice means the Privacy Notice, which is an integral part of this Terms and Conditions;

User or Users means individuals who uses Our Platform;

Third Party Content Provider is any unaffiliated person, company, or entity, that provides content or features on Our Platform and/or Features;

Platform means Our website, https://www.puragroup.com;

Product or Products means products or solutions We offer in relation to Our business activities; and

Terms and Conditions means this Terms and Conditions.

2. Use of Our Platform and/or Features

Use of Our Platform and/or Features is subject to the conditions set forth in these Terms and Conditions. We reserve the right to add, change, modify, suspend, or discontinue any part of the Platform and/or Features, at Our discretion, at any time. In addition, We may restrict Your access to part of or all of the Platform and/or Features at Our discretion, without prior notice.

This Platform is used to provide information about Us, including but not limited to information about the company, Products, facilities, Our Corporate Social Responsibility programs, job opportunities, and other information related to Our business activities.

Through this Platform, Users can access Our Features to:

a. obtain information related to the company profile;
b. contact Us to obtain information related to Our Products;
c. receive e-brochures that will be automatically sent to the User's email address;
d. submit comments or suggestions to Us;
e. submit partnership offers as a partner in business activities, including but not limited to marketing, promotion, innovation collaboration, or other forms of business collaboration; and/or
f. access and obtain information related to job opportunities.

3. Personal Data

We may collect, store, process and share Your personal data which You have provided when accessing or using Our Platform and/or Features, by implementing appropriate security measures, including encryption and access control, and ensuring that the data is only used for lawful purposes and in accordance with applicable laws. By using Our Platform, Features and/or providing Your personal data, You represent that You have read and consent to Our Privacy Notice, which is an integral part of this Terms and Conditions.

4. Third Party Content

Our Platform and/or Services may contain content and information provided by a third party (“Third Party Content”), including content related to maps and/or social media. Third Party Content are subject to the applicable terms and policies of the third parties that offer them (“Third Party Content Provider”). We are not responsible for any claims, demands, losses, or legal liabilities arising from Third Party Content and You are required to read and understand the terms and conditions applicable to such Third Party Content. By accessing or using Third Party Content, You are deemed to have agreed to be bound by the terms and conditions, privacy policies, and/or other terms and conditions set forth by the Third Party Content Provider.

We may, but not obliged to, verify that Third Party Content are aligned with this Terms and Conditions and the Applicable Laws. In the event that such Third Party Content is inaccurate and We are informed of such inaccuracy, We will attempt to correct the inaccuracies as soon as We reasonably can.

5. Your Statement / Representations & Warranties

You represent and warrant that You are at least 18 (eighteen) years old or are married and are not under guardianship or custody and that You are legally capable and have the right to enter into this Terms and Conditions according to the Applicable Laws. Should You do not meet such criteria and You still access or use Our Platform, Features, and/or Third Party Content, You warrants that such actions, including Your action of accessing or conducting activities on Our Platform and/or Features are based on the consent of Your parents, guardians or custodians.

You agree to access or use of Platform, Features and/or Third Party Content solely for the purpose specified under this Terms and Conditions and that You warrant not to misuse the Platform, Features, and/or Third Party Contents provided to You.

You understand and agree that all risks arising from the use of the Platform, Features and/or Third Party Content are entirely Your responsibility, and You hereby release Us from any claims regarding damages, losses, potential losses or other forms that is caused or is a system disruption as it may be made by unauthorized parties.

You explicitly release Us, including but not limited to Our officials, Our employees, directors, commissioners, representatives and agents from all obligations, consequences, material or immaterial losses, claims, fees (including advocate fees and or legal fees that might arise) or legal responsibilities that arise or may arise because of Your violation of this Terms and Conditions, or in connection with Users, or Third Party Content Provider

BY CONTINUING ACCESS OR USE TO THE PLATFORM AND/OR SERVICES, YOU HEREBY AGREE TO BE SUBJECT TO AND COMPLY WITH ALL OF APPLICABLE LAWS AND THIS TERMS AND CONDITIONS INCLUDING ALL OF ITS AMENDMENTS. IMMEDIATELY STOP TO ACCESS OR USE THE PLATFORM AND/OR SERVICES IF YOU DO NOT AGREE TO ANY PART OF THIS TERMS AND CONDITIONS.

6. Intellectual Property

Our Platform and/or Features are protected by intellectual property rights as available under the laws of the Republic of Indonesia, which are registered on behalf of Us or Our affiliates. The following items, such as but not limited to, names, images, photos, logos, source codes, designs, trademarks, technologies, database, business process and models are also protected by intellectual property rights as made available under the laws of the Republic of Indonesia. We have all the rights and interests of the Platform and/or Features, including all intellectual property rights of the features contained within the Platform and/or Features.

Any duplication, distribution, creation of derivative works, sale or offer to sell, display in whole or in part, and use of Our Platform and/or Features from unauthorized accesses, such as but not limited to the use of additional Platform, Platform which is published from unofficial digital markets or other means of unofficial publication, which diverges from this Terms and Conditions as well as the intended purposes determined by Us, is a violation of Our intellectual property rights.

You may not:

a. delete any copyright, trademark or other ownership notices contained in the Platform and/or Features;
b. copy, modify, adapt, translate, create derivative works from, distribute, license, sell, transfer, display in public either in part or in full, reverse engineer, transmit, move, broadcast, decompile, or disassemble any part of or in other ways to exploit the Platform without prior consent from Us;
c. license, sublicense, sell, resell, remove, transfer, distribute or commercially exploit or make available to other parties the Platform and/or software by means of creating an internet link to the Platform or frame or mirror any software on other servers or wireless or internet-based devices;
d. launch automated programs or scripts, including, but not limited to, web spiders, web crawlers, web robots, web ants, web, indexers, bots, viruses or worms, or any program that might create multiple server requests per second, create heavy burdens or impede the operation and/or performance of the Platform;
e. use site searching or retrieval Platforms, other manual or automatic devices for scraping, indexing, surveying, data mining, or in any way multiplying or avoiding the navigation structure or presentation of the Platform or its contents;
f. publish, distribute or reproduce in any way materials that are copyrighted, trademarked or other information We own without prior written consent from Us or the rights owners who license Us the rights; and/or
g. use or unofficially access the Platform to damage, weaken or jeopardize any aspect of the Platform, Features and/or related systems and networks.

7. Limitation

The Platform that We provide is “as is”. We do not represent, warrant, nor be liable of that the reliability, timeliness, quality, stability, availability, accuracy, completeness and or security of the Platform, along with the content on the Platform, will fulfil Your needs and Your expectations, including the Services and Third Party Content, that may be available under Our Platform. We shall not be responsible for any loss or damage caused by any Third Party Content that are available or Your failure or mistake in complying with Our Terms and Conditions. You must contact and confirm with Us before using Our Products or Features.

Our platform may experience limitations caused by factors beyond Our control, including but not limited to disruptions in data processing, and other disruptions due to internet connection, network disruptions or the condition of Your device (such as damage, being turned off, not connected to the internet or out of range). We are not responsible for service delays, access failures, or information delivery issues, nor for any losses arising from such disruptions, whether directly or indirectly. We are not responsible for all Your activities on Our Platform, and any use of the Platform is Your sole responsibility. However, to support convenience, security, and optimal use, We reserve the right to monitor activities within the Platform to ensure compliance with the Terms and Conditions, Applicable Laws, court orders, and/or administrative agencies or other applicable government agency requirements applicable to this Platform.

We have no responsibility whatsoever, including to take further action or legal action deemed necessary by Users, for any problems or disputes arising between Users. When We facilitate the resolution of problems or disputes between Users, We do not act as a mediator and such actions do not give rise to any further responsibility on Our part.

We have no responsibility, for any and/or all parts of Third Party Content as described above, including images, information, data, all forms of trademarks, all other forms of information that may be contained in Third Party Content, including all information obtained from links to websites or other materials beyond Our control. We will take reasonable steps to ensure that such Third Party Content does not violate Applicable Laws and Our Terms and Conditions, and We reserve the right, but are not obligated to, to remove such Third Party Content from Our Platform if We understand that such Third Party Content violates Applicable Laws and/or Our Terms and Conditions, including if such Third Party Content is misleading, inaccurate, or infringes on the intellectual property rights of Us or other parties.

8. Violations of the Terms and Conditions

We may impose sanctions if We find any violation of this Terms and Conditions, including but not limited to the implementation of one or more of the following actions:

a. Access Termination
We may limit or terminate access to Our Platform temporarily or permanently;
b. Written Warning
We may issue an official warning regarding the violation and demand the cessation of such activity;
c. Civil Damages
We may seek legal compensation for losses incurred as a result of the violation.

We reserve the right to take any legal action deemed necessary, including but not limited to criminal proceedings.

If You believe that a User on Our Platform has violated this Terms and Conditions, You may report the matter to Us through the official contact channels provided in Article 12.

9. Governing Law

The Terms and Conditions shall be governed according to the laws of the Republic of Indonesia.

10. Complaints and Disputes

Any and all disputes arising from the use of the Platform, Features and/or the implementation of this Terms & Conditions, You acknowledge and agree that You will, as an initial matter, email Us to describe to Us the nature of Your complaint or dissatisfaction, which We may try to resolve amicably. However, if for some reason Your problem or dispute is not resolved satisfactorily within 30 (thirty) days after Our receipt of Your written description of it, You agree to the further dispute resolution, which is are subject to the exclusive jurisdiction of the Kudus District Court.

11. Language

This Terms and Conditions is made in Indonesian and English. The Indonesian language shall be the governing language and in the event of differences or inconsistencies between the Indonesian version and the English version, the Indonesian version shall prevail.
